What is happening in Tennessee?
What has already happened:
The Fertility Treatment & Contraceptive Protection Act (HB 533 / SB 449)
This landmark law, effective July 1, 2025, guarantees that individuals in Tennessee have the right to receive fertility treatment and contraception, and that state law cannot prohibit “activities associated with fertility treatment.”

What this law states:
Defines “fertility treatment” broadly, including IVF, embryo testing, gamete donation, and more.
Does not guarantee insurance or government funding for fertility treatment.
Establishes Tennessee as one of the first Southern states to codify protections for fertility treatment access.
Why it matters:
This law provides legal clarity and protection for fertility patients and providers. HOWEVER, it does not solve the biggest barrier — cost and insurance coverage.
Bills to Watch:
HB 0945 / SB 0793 – This proposed bill would have placed limits on how many embryos someone can store and restricted genetic testing of embryos in IVF. That bill was defeated in committee, but it shows what threats still exist.
Personhood Amendment (HJR 7) – Although not yet advanced, this kind of constitutional amendment seeks to define life from fertilization, which could impose major restrictions on IVF treatments and embryo handling.
What to watch:
Committee hearings and amendments
Whether bills include language about embryo status, storage, or disposal
New bills that mandate or limit insurance coverage for fertility treatment
What This Means for Families:
Legal protections & clarity now exist in Tennessee — you won’t be denied fertility treatment simply because you choose IVF or genetic testing.
But the biggest barrier remains cost: without insurance mandates, many families still face financial obstacles.
Threats still remain: bills limiting embryo storage, defining embryos as persons, or reversing protections.
Advocacy matters: your voice, your story, and your action help shape the laws and protect the right to build a family.
